Will of James H. McBroom

Michele writes:

In the search for my family roots I have found several wills and wanted to share them as they may be of interest to others.  The following has been retyped exactly as it appears (with typographical errors as well as punctuation) from the typed will of James H. McBroom.  The will can be found in the Washington County Courthouse, Washington, Pennsylvania.  Said will is located in the Will Books at Volume 50, Page 396.

                                                Late of Donegal Township, Washington County, Pennsylvania,

JAMES H. McBROOM           deceased, and GRANT OF LETTERS TESTAMENTARY

            Before the Register of Wills of Washington County, personally appeared Carrie McBroom who being duly sworn says that James H. McBroom late resident of Donegal Township, a citizen of U.S. died at 7:30 o’clock p.m., on the 4th day of April, A. D. 1933, leaving and estate of the estimated value of $20.00 personalty, and $600.00 realty, said real estate being located in Donegal Township, Washington County, Pa., adjoining West Virginia State Line, Mrs. J. C. Milholland  & Son, Clyde Holmes, W. F. Jones & Sons, containing 80 acres, more or less.  Pittsburgh Coal sold.

 

The decedent’s legatess and devisees are as follows:

            Petition prays that the paper writing filed herewith dated 2nd day of January, 1930, May be admitted to probate as the last Will and Testament of said decedent, and to grant of Letters Testamentary thereon to Carrie McBroom whose postoffice address is Bethany, W. Va., R. D. #1.

            And now may 29, 1933, comes Carrie McBroom who being duly sworn doth depose and say that she will well and truly administer the goods and chattels, rights and credits of James H. McBroom, deceased, to the best of her skill and judgment in strict compliance with the law of this Commonwealth, mindful of the laws relating to inheritance taxes.

I, James H. McBroom of Claysville, Washington Co. Pennsylvania. being in good health declare this my last will and testament, that is to say:

 

First.  I give and bequeath to my wife Carrie McBroom. the one half of all my real estate. the remainder of my real estate I give and bequeath to my three children, Fay, Carl, and James. to share and share alike, they to pay my daughter Maggie McAdoo, three Hundred dollars, ($300.00) My two grand daughters, Mildred and Mare two Hundred each. ($200.00) the sheep consisting of fifty three head, I give to my children, Fay, Carl, and James. McBroom.

 

I hereby appoint my Wife Carrie McBroom Administratriks of this my last will and testament

 

In Witness whereof, I hereunto set my hand and seal at Bethany, aforesaid., the second day of January, Nineteen hundred and thirty. (1930)

Signed and sealed by said James H. McBroom who at the same time published and declared the same as and fore his last will and testament, in the presence of us who, in his presence and in the presence of each other, and his request, have hereto subscribed our names as witnesses:

            Personally appeared Thomas N. Blair and A. Markley Barnes who, after being duly qualified according to law depose and say that they are well acquainted with the handwriting of James H. McBroom Deceased, Testator tot he foregoing will dated Jan. 2, 1930, and the signature of said James H. McBroom is in his own proper handwriting as they, the affiants, verily believe.

            Also that the subscribing witnesses are not now within the jurisdiction.

            And now Aug. 2, 1933, It being adjudged that said will has been duly proved, It is hereby admitted to probate and ordered to be recorded and Letters Testamentary are issued to Carrie McBroom in said Testament named who was duly qualified.
