Deed to Presley Neville, Esq. from
Wm. Beard, Joseph Beard, and Charles McGowan

The following transcription was submitted by Boyd C. Roach Jr. of Washington Co., PA for inclusion at the Genealogy in Washington Co., PA web site in December 1998.

Boyd writes:

"I have in my possession an original sheepskin deed dated May 28, 1802 where Presley Neville Esquire, son of General Neville, purchased certain tracts of land from Wm. Beard, Joseph Beard, and Charles McGowan for the sum of 1,850 pounds. At this time the land was in Allegheny C0. however part of the land is now Peters Twp. in Washington Co. I thought this might be of some interest . I also have a letter from Neville dated September 15, 1808 before a JP that he had title papers to certain lands from David Fleming to John Campbell which had been lost. Neville swore that John Campbell had been in full possession of this land except when driven off by Indians."

 THIS INDENTURE made the twenty eighth day of May in the year of our Lord 
 one thousand eight hundred and two, between William Beard, Joseph Beard, 
 and Charles McGowan of the State of Kentucky, of the one part, and 
 Presley Nevill Esquire of the Borough of Pittsburgh in the State of 
 Pennsylvania, of the other part,Witnesseth, First, whereas Colonel 
 John Campbell late of the State of Kentucky, deceased, was at the time
 of his death seized in Fee Simple of certain lands in the County of 
 Allegheny aforesaid situated on the waters of Chartiers creek and 
 whereas the said John Campbell by his last will and testament made the
 twenty fifth day of July in the year of our Lord one thousand seven and 
 eighty six, did devise all his real and personal estate to Charles Sims, 
 Richard Taylor, William Polliot, and Philip Ross, in trust for the uses 
 in the said will mentioned; By virtue of which said last will and 
 testament of John Cambell, deceased, the above named Richard Taylor the 
 only acting executor of the said will (the other executors having 
 refused to act) by his letter of attorney made and bearing date the 
 twenty second day of March in the year of our Lord one thousand eight 
 hundred and two, empowered William Beard one of the devisees under the
 aforesaid will of John Campbell, deceased, to divide the lands of the 
 said John Campbell deceased, situated on the waters of Chartiers creek
 in Allegheny County aforesaid amongst the several devisees under the 
 said will, agreeably to the terms of an agreement before that time 
 entered into by the said devisees, as by the said letter of attorney and 
 article of agreement recorded in the office for recording of deeds in 
 and for the County of Allegheny in the Commonwealth of Pennsylvania, 
 reference thereunto being had may more fully and at large appear. And 
 whereas the said William Beard by virture of the aforesaid letter of 
 attorney did apportion out and divide the aforesaid lands amongst the 
 devisees in the following manner to wit, besides the shares appropriated 
 to the other devises, the said William Beard and Charles McGowan were to 
 have possess and enjoy three several tracts of land surveyed on orders, 
 one in the name of David Fleming for three hundred acres, numbered three 
 thousand two hundred and nine and dated the ninth day of May in the year 
 one thousand seven hundred and sixty nine; one in the name of John Boggs 
 for three hundred acres numbered one thousand one hundred and ten, and
 dated the third day of April in the year one thousand seven hundred and 
 sixty nine; and one in the name of John Street for three hundred 
 acres,numbered three thousand one hundred and thirty eight, and dated 
 the twenty first day of April in the year one thousand seven hundred and 
 sixty nine, containing in the whole agreeably to the return of Deputy 
 Surveyor nine hundred and twenty two acres and thirty four perches and
 allowance of six per cent for roads etc. and the said Joseph Beard was
 to have possess and enjoy a tract of land surveyed in the name of John
 Campbell containing three hundred and thirty two acres and allowance 
 etc. and a tract of land surveyed on an orderin the name of Thomas 
 Christy for three hundred acres, numbered two thousand seven hundred and 
 three, dated the third day of April in the year one thousand seven 
 hundred and sixty nine, and containing according to the survey two 
 hundred and forty one acres and allowance of six per cent, as by a 
 certificate of the said division and appropriation, signed by the said
 William Beard and recorded in the office for recording of deeds etc. in 
 and for the County of Allegheny in the Commonwealth of Pennsylvania, 
 reference thereunto being had may more fully and at large appear. And 
 whereas Sarah Beard, one of the said devises, did, by her letter of 
 attorney made and bearing date the twenty fourth day of March in the 
 year of our Lord one thousand eight hundred and two, authorize and 
 empower the said William Beard, Joseph Beard and Charles McGowan to 
 sell, dispose of and convey in Fee Simple all her share of the aforesaid 
 lands situate on Chartiers creek aforesaid accruing to her under the 
 aforesaid will of John Campbell, deceased, as by the said letter of 
 attorney recorded in the office for recording of deeds etc. in and for
 the County of Allegheny in the Commonwealth of Pennsylvania reference 
 thereunto being had may more fully and at large appear. And whereas the 
 aforesaid Richard Taylor, the only acting executor of the last will and 
 testament of the said John Campbell deceased, and trustee under the said 
 will for the uses therein mentioned did by his two several deeds, made
 and bearing date the twenty second day of March in the year of our Lord 
 one thousand eight hundred and two, grant, bargain and sell to the said 
 William Beard and Charles McGowan, the aforesaid three several tracts of 
 land in the name of David Fleming, John Boggs, and John Street, and said 
 Joseph Beard the aforesaid two several tracts of land surveyed in the 
 names of John Campbell and Thomas Christyas by the said deeds recorded
 in the office for recording of deed etc. in and for the County of 
 Allegheny in the Commonwealth of Pennsylvania,reference thereunto being 
 had may more fully and at large appear. NOW this Indenture witnesseth,
 that that the said William Beard, Joseph Beard and Charles McGowan for
 and in consideration of the sum of one thousand eight hundred and fifty 
 pounds lawful money of Pennsylvania to them in hand paid by the said 
 Presley Nevill Esquire, the receipt whereof is hereby acknowledged, have 
 granted, bargained and sold, aliened, released, enfeoffed and confirmed, 
 and by these presents do grant bargain and sell, aliene, release, 
 enfeoff and confirm unto the said Presley Nevill Esquire, his heirs and 
 assigns four of the four aforementioned tracts of land, wit, those 
 surveyed in the names of David Fleming, John Boggs and John Street on 
 numbers three thousand two hundred and nine, one thousand one hundred 
 and ten, and three thousand one hundred and thirty eight, containing in 
 the whole nine hundred and twenty two acres and thirty four perches and 
 allowance etc. and the tract surveyed in the name of Thomas Christy on
 order number two thousand seven hundred and three, containing two 
 hundred and forty one acres and allowance etc. together with all and 
 singular the heriotitaments and appurtenances to the same belonging or 
 in any wise appertaining, rents, issues and profits thereof, and all the 
 rights, title interest and claim of them the said William Beard, Joseph 
 Beard and Charles McGowan of in and to said described premises with the 
 appurtenances, to have and to hold the said four described tracts of 
 land with the appurtenances to the said Presley Nevill Esquire his heirs 
 and assigns, to the only proper use, benefit and behoof of him the said 
 Presley Nevill Esquire, his heirs and assigns, for ever. And the said 
 William Beard, Joseph Beard and Charles McGowan do hereby for themselves 
 their heirs, executors and administrators, covenant and agree to and 
 with the said Presley Nevill Esquire, his heirs and assigns, that they
 the said William Beard, Joseph Beard and Charles McGowan, and their 
 heirs, executors and administrators shall and will warrant and fore ever 
 defend the above granted tracts of land to the said Presley Nevill 
 Esquire, his heirs and assigns, against all persons whatsoever  lawfully 
 claiming the same or hereafter to claim under them or either of them or 
 under the late John Campbell of Kentucky, deceases, under whom they 
 claim title; and they do further hereby signify it as their desire and
 wish that patents for the above grants four several tracts of land may
 issue in the name of the said Presley Nevill Esquire, and they do hereby 
 authorize him or his heirs to obtain the same in his or their names.  In 
 witness whereof the said William Beard, Joseph Beard and Charles  McGowan 
 have hereunto set their hands and seals this day and year first above
